Ontario Bill 190 Compliance Guide — O. Reg. 480/24 Explained
Bill 190 is Ontario's Working for Workers Five Act, 2024. It amends the Occupational Health and Safety Act (OHSA) to add new obligations around workplace washrooms — keeping and posting cleaning records so workers can see when facilities were last cleaned.
Key Dates
July 1, 2025: OHSA amendments take effect — employers must ensure washrooms are clean and maintain cleaning records.
January 1, 2026: O. Reg. 480/24 clarifies posting requirements and record content.
Who Must Comply
All Ontario employers who provide washroom facilities for workers must comply. Constructors on construction projects have additional obligations under O. Reg. 482/24.
Penalties for Non-Compliance
Under OHSA, individuals face fines up to $100,000 and/or 12 months imprisonment. Corporations face fines up to $1,500,000 per offence.
Record Requirements
At minimum, the date and time of the two most recent cleanings for each washroom must be posted in or near the washroom, or made available electronically with clear access instructions.
